JUDGMENT
Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking electric connection to LT residential house.
Notice to opposite parties was issued on 07.7.2023 as per order dtd.06.7.2023 of this Commission but the opposite parties did not appear on the date fixed i.e. on 17.7.2023. This Commission vide order dtd.17.7.2023 directed as under;
“Notice was issued on 06.7.2023 to file any objection if any on 17.7.2023 but till today non appears for opposite parties.
Heard the counsel for complainant and perused the records. The partion suit has already been disposed of and Hon’ble Civil Court has rejected the payer of co-sharer but on the remark of line man, J.E. sitting over the matter.
Electricity being an essential service for which complainant has already paid his fees and entitle to get new connection. But in spite of receipt of the notice the opposite parties have not appeared before this Commission and we direct the opposite parties to provide temporary connection within a period of seven days from the date of receipt of this order and file their objection if any on 09.8.2023, failing which the concerned officer will pay Rs.100/-per day to complainant if not comply the above order.”
In spite of receipt of notice dtd.07.7.2023 and order dtd.17.7.2023 the opposite parties have neither filed any written version nor supplied electric connection which goes to prove that opposite parties have nothing to say. In the meantime more than one month has passed and the family of complainant is passing these days without electricity which is the basic need in day to day life.
We therefore direct the opposite parties to supply electric connection to complainant on receipt of required dues which has to be communicated by opposite parties to complainant within 03 days of receipt of the order and on payment of dues if any the electric connection shall be supplied immediately to the house of complainant within 03 days and for delay beyond the stipulated period the opposite parties (who is/are responsible) shall be liable to pay Rs.100/- per day to complainant. With the aforesaid observation and direction consumer complaint is disposed of. No cost.
