This C.C.Case No. 185/2023 has been filed U/s-35 of C.P.Act, 2019 seeking following relief:-
Honbl’e Commission may direct the Ops not to disconnect or disturb the power supply to the house of the Petitioner and also award to sum of Rs. 90,000/- for mental agony, harassment & litigation expenses by Complainant.
Ld. Counsel for Complainant remained absent on repeated calls. Heard Counsel for Ops. Since the matter relates to Section-135 of Electricity Act which cannot be adjudicated by this Commission in view of the decision of Honbl’e Apex Court in the case of U.P. State Power Transmission Corporation vrs Anis Ahmed.
Keeping in view the aforesaid position of law taking a lenient and as agreed by Opp. parties, we direct the Ops to settle the dispute by deducting 40% of the bill as is being deducted normally by the Ops and if Complainant has already paid then the same shall be adjusted in future bill and if not paid the same shall be paid by the Complainant in 6 to 8 installments along with regular bill.
With the aforesaid observation & direction the C.C.Case No. 185/2023 is hereby dismissed & accordingly disposed off.
Issue extract of the order to the parties concerned.
