Final Order / Judgement

                   Complainant Ganeswar Nayak has filed this case u/s 35 of the CP Act – 2019 alleging deficiency of service on the part of the Opposite Parties for not crediting his payment in his account and for claiming the energy charges for the second time from him and praying therein for direction to the OPs to credit a sum of Rs. 660/- in his account and to pay a sum of Rs. 40, 000/- towards mental agony and a sum of Rs. 10, 000/- towards cost of litigation.

  1. Brief fact leading to the case is that the complainant had deposited a sum of Rs. 660/- on 11.12.2019 towards his energy bill under Consumer No. 906134120405. The complainant noticed that the amount has been shown as arrear in his energy bill and he lodged a complainant before OP No.2 for correction of energy bill. But in spite of repeated approaches, the matter was not settled for which, he filed this case before this Commission for the reliefs as discussed in the preceding paragraphs.

 

  1. After receipt of notice from this Commission, the Opposite Parties did not appear, nor filed any written statement. One letter was received in the pad of TPWODL addressed to the Commissioner, DCDRC, Nuapada in which someone has signed for Executive Engineer, ANED, Nuapada. As the OPs did not appear nor filed any written statement, they were set ex-parte and the case was accordingly taken up for disposal.

 

  1. As the OPs did not appear, nor filed any written statement, it is deemed that they have admitted the allegations raised against them.

 

  1. On perusal of record, it is seen that the complainant had deposited a sum of Rs. 660/- on 11.08.2019 vide receipt No. 1646165 of WESCO. Subsequently, this amount was not credited to his account and was shown as arrear and the complainant has time and again approached to the OPs for redressal of his grievance and his grievance was not attended. The complainant is a BPL card holder and by such act of the Opposite Parties, he has suffered a lot and was compelled to run from his village Kodobedha to Nuapada to file this case. It is clear from the documents on record that he has paid the electric dues and it is presumed from the silence of the Opposite Parties that the allegation of the complainant is true. As a case of deficiency in service is made out against the Opposite Parties, they are liable to compensate the petitioner for loss and harassment sustained by him and hence the order.

 

O R D E R

 

The complaint petition is allowed ex-parte against the OP No. 1 and 2 and they are jointly and severally liable for causing deficiency in service to the complainant. The OPs are directed to credit a sum of Rs. 660/- in the account of the complainant which has been paid on 11.12.2019 by him and revise all the subsequent bills accordingly. The OPs are further directed to pay a sum of Rs. 5,000/- (Five Thousand) for deficiency in service and a sum of Rs. 2,000/- (Two Thousand) to the complainant towards cost of litigation. The order is to be complied within a period of 30 days from the date of receipt of the order failing which the entire amount shall carry interest @ 12% from the date of order till it is paid to the complainant.
