JUDGMENT
Matter relates to Sec.126 of I.E. Act, 2003 and as per the settled position of law as decided by the Hon’ble Apex Court in the case of U.P. Power Corporation Ltd., Vrs. Md. Anis Ahmed, Consumer Commission has no power entertain matter relating to Sec.126 of Electricity Act.
We have heard both parties and the S.D.O., Jagatsinghpur Mr. D.K. Sahoo who is present before this Commission very fairly submitted that if complainant makes an application to settle the dispute it shall be considered and minimum up to 40% deduction can be done. Taking into consideration of the aforesaid fact, we direct that if complainant makes an application to opposite party No.2 the same shall be considered by opposite party No.2 sympathetically and give minimum deduction/rebate up to 40% as assured and provide/condition the electric connection in accordance with rules. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
