ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

 

                                                                                               JUDGMENT

            This is a case U/s.126 of Electricity Act, 2003 where this Commission has no power as per the settled position of law, in the case of U.P. Power Corporation Ltd. Vrs. Md. Anis Ahmed, with regard to Sec.126, 135- 140 of Electricity Act, 2003 but in view the assessment made provisional bill was assessed as Rs.1,18,978/- and final assessment has been fixed at Rs.71,500/-. The counsel for complainant submitted that complainant has already paid substantial amount.

            We therefore direct the opposite parties to receive the rest amount out of Rs.71,500/- in 06 monthly EMI and complainant shall pay his regular bill and in addition to that shall pay 1/6th of pending final assessment amount within 45 days. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.

            Pronounced in the open Commission on this 14th Dec.,2023.
