The present Miscellaneous application is filed to review the order dated 06.09.2022 passed by this District Commission. As per section 40 of the Consumer Protection Act, 2019, the powers to review its own order are limited to the extent as under:-
“40. Review by District Commission in certain cases
The District Commission shall have the power to review any of the order passed by it if there is an error apparent on the face of the record, either of its own motion or on an application made by any of the parties within thirty days of such order.”
The perusal of the order dated 06.09.2022 passed by this District Commission and the application filed by the applicant does not reveal any error apparent on the face of the record, which warrants any review.
Hence, the present Miscellaneous application stands disposed off. During the pendency of this application, the applicant also submitted the disputed packet of Biscuits, which was not part of the complaint at any point of time. The applicant/complainant is at liberty to receive it back from the Commission under proper receipt, if he so desires. Applicant/complainant is at liberty to approach the appropriate court of law for the redressal of his grievance, if any. Copy of the order be supplied to the parties, free of costs. File be consigned to record room.
