ORDER :- (Per Mr.S.R.Khanzode, Hon’ble Presiding Judicial Member)

(1)              Heard both the parties.  There is delay of 13 days for filing this appeal.  Hence, this application for condonation of delay has been filed by the appellant.  The reason for delay is assigned to routine administrative causes.  In absence of any evidence to rebuttal, we accept the same.  The delay is neither intentional nor malafied. 

(2)               Under the circumstances, we find the delay is satisfactorily explained.  Hence, we hold accordingly and pass the following order.

ORDER

(1)  Application of condonation of delay is allowed subject to payment of costs of ` 1,000/- which applicant/appellant shall pay within 30 days from today and failing which the application shall stand automatically dismissed without any further reference to the Commission.

(2)  Subject to Payment of costs ` 1,000/-, as aforesaid, list the appeal for admission on 13/10/2011.
