Present :-          Shri Ashish Prakash advocate for complainant.

                    Shri P. Vijay Kumar advocate for OP.

           Rejoinder and Evidence by way of affidavit not filed by complainant. Learned counsel for opposite party pointed out that total value of the flat is Rs.2,14,89,233.80/. Therefore, this forum has no pecuniary jurisdiction to try this complaint. He further argued that Hon’able National Commission in order dated 07.10.2016 passed in appeal no.644/2015 titled Parikshit Parashar V/S M/S Universal Buildwell Pvt.Ltd. and others held that total value of the flat is to be seen For the purpose of pecuniary jurisdiction.

          Learned Counsel for complainant admitted that total price of the flat is Rs. 2,14,89,233.80/-. Therefore, in view of Parikshit Parashar’s case (supra) this forum has no pecuniary jurisdiction to try the complaint.

          Therefore, complaint is returned for presentation before competent forum of jurisdiction. File be consigned to record room.
