CONSUMER COMPLAINT NO.713 OF 2017

  1. IREO RiveRiver Pvt. Ltd. (An IREO Group Company) SCO No.6, 7, 8 First and Second Floor, Sector-9D, Chandigarh 160009 through its Authorized Signatory/Partner/Prop.
  2. Site Manager, IREO, FiveRiver Project at Pinjore, Panchkula, Haryana.

ORDER

 

 

  1. On 12.10.2023, the State Commission had passed the following order:-

“The complaint is at the stage of recording evidence of the complainant.

On 11.04.2023, when none appeared for recording evidence of the complainant, the proceedings were adjourned in the interest of justice but it was made clear that in case, the complainant failed to record her evidence on the adjourned date, the complaint might be dismissed for want of prosecution. Position remained the same on the adjourned date i.e. 03.08.2023. Even today, none has put in appearance on behalf of the complainant.

It appears that the complainant is no more interested in prosecuting the present complaint. Still in the interest of justice, adjourned to 08.12.2023 for recording evidence of the complainant.

It is however made clear that in case, there is no representation on behalf of the complainant on the adjourned date, the complaint shall be dismissed for want of prosecution.”

 

  1. On 08.12.2023, 15.02.2024 as well as on the previous date i.e. 05.03.2024, none has put in appearance for the complainant. Further, the complainant has not taken any steps to record her evidence.
  2. In view of the above and also in view of the order passed on 12.10.2023, the State Commission has no other option but to dismiss the complaint for want of prosecution.
  3. Resultantly, the complaint is hereby dismissed in default for want of prosecution.
  4. Application(s) pending, if any, stand disposed of in terms of the aforesaid order.
  5. A copy of this order be provided to all the parties free of cost as mandated by the law. The order be uploaded forthwith on the website of the Commission for the perusal of the parties.
  6. File be consigned to record room along with a copy of this order.
