            Complainant purchased a mobile phone from opposite party for Rs.4550/- on       3-6-2014 within months of the purchase itself the phone developed complaints.  The company provides one year warranty.  Complainant returned the phone to the dealer for rectifying the defects, dealer took 42 days to rectify the defects. After repair also the phone frequently developed complaints as the product is of inferior  quality, not fit to serve the purpose.  Due to the frequent complaints of the mobile complainant suffered great mental pain.  Hence the complaint to refund the price of the device with a compensation of Rs.10,000/-.

2.         Eventhough opposite party was present in the court on 20-06-2015 for discussing the matter in the adalath, matter is not settled and no version filed.  Thereafter opposite party did not turned up.

3.         Complainant filed proof affidavit.  Ext.A1 is the bill issued by opposite party to the complainant.  Mobile phone should be defect free so that it will serve the purpose  frequently developing complaints points out that the device is faulty and of inferior quality. Dealer took 42 days to repair the mobile shows the negligent  approach of the dealer.  This amounts to deficiency in service.

4.         An ordinary man purchasing a mobile for his regular personal use and if the device is faulty the dealer and company jointly and severally liable to suffer the loss.

            Hence the complaint is allowed directing the opposite parties  to refund the price of the mobile phone i.e. Rs.4550/- with   cost of Rs.2000/-.  Time for compliance is 30 days from the date of receipt of copy of the order.
