JUDGEMENT

1. An application has been moved on behalf of complainant wherein it has been stated that OP i.e. INTEX SERVICE CENTER may be directed to handover the handset of the complainant.
2. Briefly stated the facts of the present case are that the complainant had filed the complaint bearing C.C. No. 603/15 with date of institution as 14.08.2015, which was dismissed vide order dated 01.12.2016. In the said application the complainant has prayed for direction to OP to return handset of the complainant. The notice of the present application was served upon OP and  dasti summon was also served by the complainant, same was returned stating to be refused “affidavit of the complainant in support of service stating that the OP had refused to be accepted by the OP. Hence, they were proceeded ex-parte.
3. We have perused the material on record which substantiate the averments of the complainant that his handset was still with the service centre and OP has failed to appear despite service, the averments of the complainant has remained unrebutted. Hence, we allow the present application and direct OP to return the handset of the complainant within 15 days from the date of receipt of the order, if the said order is not complied within the time frame, the complainant shall be at liberty to file fresh complaint.

Order be given dasti.

File be consigned to record room.
