File taken up today on the application moved by the counsel for the complainant stating therein that he has received telephonic instructions from the complainant that matter between the parties are going to be settled amicably subject to certain terms and conditions and the complainant wants to withdraw the present complaint.

            Sh.Saurabh Sharma, Adv.counsel for the complainant that he has received telephonically instructions from the complainant that matter has been amicably settled between opposite parties No.2 & 3 and in view of the settlement, opposite parties No.2 & 3 have refunded Rs.4595/- which was taken in excess and as well as Rs.4000/- has been given to the complainant as compensation by the opposite parties No.2 & 3 and that complainant does not want to proceed further with the present complaint and same may kindly be dismissed as withdrawn. Consequently, in view of the statement suffered by the counsel for the complainant, present complaint is ordered to be dismissed as withdrawn. File be  consigned to the record room.
