As per the case, the complainant booked air-tickets of the flight of Opposite Party for 16.6.2017 from Chandigarh to Delhi via Flight NO.6E 455 and from Delhi to Chennai via flight NO.6E 443 and paid a total sum of Rs.4707/- (Ann.C-1). It is averred that the said amount of Rs.4707/- included Rs.600/- paid extra for reserving an advance seat for herself in Flight i.e. Seat 1C. However, when the complainant undertook the journey in the said booked flight of the Opposite Party, she was shocked when she was given another troublesome, tiresome, problematic & inconvenient Seat 28D at the backside of flight instead of her already reserved seat 1C. As a result, the complainant has to face lot of physical harassment, as well as mental trauma, as she was already suffering from Arthritis. It is averred that the matter was immediately brought to the notice of Opposite Party, but despite assurance to do the needful, they did nothing and the complainant has to suffer despite being charged extra amount for reserving the seat. Hence, this complaint has been filed alleging deficiency in service on the part of Opposite Party.
2] The Opposite Party did not turn up despite service of notice sent through regd. post on 1.9.2017, hence it was proceeded exparte vide order dated 4.10.2017.
3] Complainant led evidence in support of her contentions.
4] We have heard the ld.Counsel for the complainant and have also perused the entire record.
5] In exparte evidence, the complainant has tendered his detailed duly sworn affidavit reiterating the averments as made in the complaint. It is evident from e-mail sent by the OP to the complainant (Annexure C-1) that the complainant got booked the confirmed ticket in the flight of the OP having seats No.1C DFNS. A perusal of flight boarding passes annexed with the complaint as Annexure C-2 reveals that the complainant had to travel on another seat i.e. 28D instead of the confirmed seat which has certainly caused extreme embarrassment, mental agony and physical harassment to the complainant.
6] Further, the evidence led by the complainant has also gone unrebutted and uncontroverted as none on behalf of the OP put in appearance to refute the allegations made in the complaint. It can, thus, be concluded without any hesitation that either they admit the claim of the complainant or have nothing to say in the matter.
7] In view of the above discussion, the present complaint deserves to be allowed and the same is accordingly allowed qua the OP. The OP is directed as under:
This order shall be complied with by the OP within a period of 30 days from the date of receipt of its copy, failing which they shall be liable to pay interest @9% per annum on amount as mentioned at sub-para (a) & (b) above from the date of this order till it is paid, apart from paying litigation expenses.
The certified copy of this order be sent to the parties free of charge, after which the file be consigned.
