This First Appeal came up for final hearing on 13.10.2022 and, after hearing the arguments of the appellant's side and perusing the materials on record and having stood over for consideration till this day, this Commission passes the following:-

The unsuccessful complainant before the District Commission has come up with the present Appeal, challenging the order, dated 06.04.2022, passed in C.C. SR No.89 of 2022 on the file of the DCDRC, Coimbatore, whereby, the complaint filed by him by arraying the police authorities as Opposite Parties came to be rejected at the SR stage.

It is seen that the complainant filed the case before the District Commission as against the OPs/respondents herein, who are police authorities, alleging service deficiency for their failure to initiate criminal action against the alleged wrong-doer over a dispute that seems to be civil in nature. The District Commission, after going through the factual aspects, rightly held that the complaint cannot be entertained as there is no relationship of consumer and service-provider at all exist between the parties. We do not find any infirmity in the findings as well as the ultimate rejection of the complaint at the SR Stage by the District Commission and further, we are of the view that the endeavor of the complainant is nothing but a clear abuse of process of the CP Act, for which, although we intended to impose heavy costs, we refrain from doing so by taking a lenient view.
3. In the result, the First Appeal is dismissed as devoid of any merit, by confirming the impugned order, dated 06.04.2022, passed by the DCDRC, Coimbatore, in CC SR No.89 of 2022, rejecting the complaint at the SR stage.
