FINAL ORDER / JUDGEMENT

The complainant is present personally by filing hazira.

Step is taken on behalf of O.P. No.3 / LICI through Ld. Advocate Ashim Kumar Mandal by filing official email copy dated: 10-04-2023 issued by Manager (L & HPF)/Admn. Officer (L&HPF), Asansol Divisional Office.

It appears from the record that by the previous order dated: 09-02-2023 liberty was given to the LICI for settlement of the case on the basis of available documents and the copy of the said order was served upon the Advocate for the LICI Shri Ashim Kumar Mandal for taking up the matter with the concerned authority.

Accordingly concerned LICI authority with reference to the above mentioned Order of this Commission has approved Rs.50,000/- (Rupees Fifty Thousand) only as lumpsum ex-gratia payment towards compromise against the settlement of Death Accident Benefit (DAB) in favour of the Nominee sri Ashis Kr. Ghosh/Complainant  under the Policy No.466486942 as a special case subject to furnishing consent from the complainant as is evident from the aforesaid email copy.

The complainant Sri Ashis Kr. Ghosh has submitted an application in response to the aforesaid approval giving his consent for settlement of DAB claim at Rs.50,000/- as approved by the competent authority.

In view of voluntary offer and acceptance by and between the parties regarding the settlement of DAB claim the Commission has to endorse the same in the interest of justice.

Hence it is ordered…….

That the case is disposed of on full and final settlement in the light of above observation.

The complainant may furnish necessary documents to the concerned authority as and when required for disposal and disbursement of the claim.

Both parties be supplied copy of this Order free of cost.
