Final Order / Judgement

            This is a complaint made by one Rajat Kr. Ghosh, 25/6 Sarkarpool, B B T Road, Kolkata-700 143 against Infotel service, 1A, Anduj Raj Road, Hazra, Kolkata-700 026, praying for refund of Rs.6,499/- or replace of the old mobile and to pay compensation of Rs.10,000/- and litigation cost Rs.5,000/-.

            Facts in brief are that the Complainant son of Ramkrishna Ghosh purchased a XiaomiRedmi 2 prime from Amazon India on 15.10.2015, which had service warranty of one year. Due to technical fault, Complainant submitted his phone at Infotel Service which is the exclusive service centre of the mobile. Complainant purchased the phone on 15.10.2015 at a cost of Rs.6,499/- and in April,2016 he faced some problems. He went to the service centre, OP, and deposited the mobile on 13.6.2016. OP did not hand over the mobile after repair. Complainant went to the service centre on different occasion, but of no use. So, Complainant filed this case.

            Facts in brief are that on the basis of above facts, the complaint was admitted and notice was issued. But, OP did not appear. So, the case was heard ex-parte.

Decision with reasons

            Complainant filed a petition stating that his complaint may be treated as affidavit-in-chief.

            Main point for determination is whether Complainant is entitled to the reliefs as prayed for.

            On perusal of the Xerox copy of the on-line receipt of Amazon India, it appears that Complainant purchased the mobile after paying Rs.6,499/- on October 15, 2015 and the mobile was in warranty period.

            Further, it appears that Complainant did not get back his mobile which is with the service centre.

            In the circumstances, we are of the view that if order for refund of Rs.6,000/- is allowed it will serve the purpose. There is no ground for allowing compensation and litigation cost as prayed by the Complainant.

            Hence,

ordered

            OP is directed to refund Rs.6,000/- to the Complainant within three months of this order.
