Present: None for the complainant.

               Sh. Suraj Kanwar, counsel for the OP.

 

              Today the case is fixed for reply to the stay application and application for dismissal of complaint. Reply not filed. Learned counsel for the OP submitted that arbitration award has already been passed against the complainant and vehicle in question also has been sold out. Learned counsel for the OP has also placed a copy award dated 20.05.2022 passed by the arbitrator. None has put in appearance on behalf of the complainant the position remained the same on dated 22.09.2022. It is 04:00 P.M. No further adjournment for the same purpose would be justified, at it would amount  to wastage of precious time of Commission, and harassment of the complainant. It appears that complainant is no more interested to pursue his complaint.

             Hence, the arbitration award has already been passed against the complainant and vechicle in question has already been sold out. Hence, the present complaint is hereby dismissed being not maintainable.

          The application (applications) pending, if any, also disposed off accordingly.

          Parties concerned be communicated of the order accordingly and file be consigned to the record room.
