The Complainant which is a business arbitrarily dealing in import & export of handmade paper, opened EXIM current account with OP bank. It is alleged that he was lined by Bank agents to open the account. He carried transaction in the A/C and then decided to close the a/c with balance of Rs.50,000/-. It is alleged that while returning this money bank debited Rs.2,714/- toward a penalty, which was not allegedly disclosed to him. The bank filed a reply explaining that it is a commercial transaction subject to terms of contract governing opening of current a/c for commercial purposes. It stated that complainant being in export & import business, consciously opens the account and is not a innocent illiterate entity. OP was asked to submit a/c opening form, which it has submitted with bank brochure explaining everything on the limit or request of business transaction is current account, which includes 0.30% as penalty for not doing business worth USD 20,000/-.
We have considered the matter in entirely and are of the view that complainant being business entity open the account for commercial purpose based on contract and is not a Consumer under Consumer Protection Act. Even otherwise, bank has acted according to contract & rules and no deficiency is committed by OP bank. The Complaint is dismissed.

Copy of the order be sent to the parties free of cost.
