Final Order / Judgement

The Ld. Counsel for the complainant is present.

Today is fixed for hearing on the point of admissibility of this Complaint.

At the time of advancing argument it is noticed by us that the complainant has prayed for direction upon the Ops to refund the joining fees of Rs. 17,700/-, which was debited from the savings account of the complainant on 06.03.2021.

In the petition of complaint it is stated by the complainant in the paragraph no. 5 that the complainant reluctantly accepted the proposal of the Ops and accordingly accepted the PINNACLE CREDIT CARD from the Ops. On 27.02.2021 the said card was issued in the name of the complainant and accordingly Rs. 17,700/- was debited from the savings account of the complainant towards membership fee. During advancing argument the complainant has mentioned that inspite of giving assurance to him by the Ops that the Ops will hand over vouchers worth of Rs. 15,000/- of various merchant establishment for purchase of products of his choice, the Ops did not provide him the said vouchers till filing of this complaint. On being asked by the Ld. Bench, the complainant cannot satisfy that non-providing of vouchers has been made in the prayer portion of the complaint. For this reason the complainant has filed a petition praying for withdrawal of this complaint with a view to rectify some defects as cropped up subject to liberty to him to file afresh.

Accordingly upon the perusal of the petition filed by the complainant we are of the view that liberty can be given to the complainant for withdrawal of this complaint with a view to rectification of some defects subject to fresh filing.

 

Going by the foregoing discussion hence it is ordered that the Consumer Complaint no. CC/338/2021 is hereby dismissed without being admitted. There is no order as to cost.

However the complainant is at liberty to approach before the appropriate Court/Commission for redressal of his grievance. If not barred otherwise.

The complainant is also at liberty to get return the copy of the complaint and the documents from the appropriate authority of this Commission as the complaint is not admitted. In this respect the complainant is further directed to submit a separate application praying for return of the abovementioned documents. The appropriate authority of this Commission is hereby directed to take necessary step upon receipt of the application from the complainant so that the complainant can get return of the aforementioned without any further delay.

Let plain copy be given to the parties free of cost as per CPR.
