ORDER

 

  1. The complainant, namely, Rajkumar Singh has filed complaint under the provisions of the Consumer Protection Act, 2019. The same came up for consideration before the State Commission on 14.10.2022 and on request made by the complainant, adjourned to 24.11.2022 and then to 20.12.2022, 15.03.2023, 30.05.2023, 07.09.2023, 28.11.2023, 07.02.2024 and 21.02.2024. Subsequent thereto, the complaint was taken up for consideration for today when the complainant put in appearance and pleaded that he be permitted to withdraw the complaint with liberty to file afresh before the appropriate authority i.e. before the District Consumer Disputes Redressal Commission, Bhiwani on the same cause of action. He also moved miscellaneous application, which reads as follows:

“The above noted case is pending in the Hon'ble Court and fixed for preliminary hearing for today i.e. 05.03.2024.

  1. That the applicant is the complainant in the above noted case.
  2. That the applicant wants to withdraw the present complaint because of some technical issue i.e. pecuniary amount with liberty to be a fresh file before the appropriate authority i.e. before learned District Consumer Commission, Bhiwani on the same cause of action.
  3. That the applicant wants to decide his complaint within the period of six months, because the bus related to this complaint is standing at the house of the complaint on default of the respondent since five years ago, which the applicant is suffered many losses of economically, mentally and physically.
  4. That the applicant wants to take the original documents from the Ld. Hon'ble Court, so the documents related to this complaint may be returned to the applicant, in the interest of justice.
  5. That the related cases were withdrawn by the complainant on the basis of pecuniary amount i.e. CC/46/2023 and CC/47/2023 on dated 08.01.2024 from the Court of Sh. S.P. Sood, Ld. Presiding Member of the Sate Consumer Disputes Redressal Commissioner, Haryana, Panchkula with a liberty to be a fresh file before the appropriate authority i.e. before learned District Consumer Commissioner, Bhiwani on the same cause of action.
  6. That the Hon’ble Court please be withdrawn the above noted case, in the interest of justice.

  1. In view of the stand taken by the complainant, the present complaint stands dismissed as withdrawn. However, the complainant will be at liberty to file afresh complaint before the appropriate authority on the same cause of action i.e. pecuniary jurisdiction.
  2. The original documents be also returned to the complainant after keeping photocopies of the documents from the complainant against proper receipt and as per rules, after noting down in the register, if maintained.
  3. Application(s) pending, if any, stand disposed of in terms of the aforesaid order.
  4. A copy of this order be provided to all the parties free of cost as mandated by the law. The order be uploaded forthwith on the website of the Commission for the perusal of the parties.
