CONSUMER COMPLAINT NO. 336  OF  2019

AWARD

          Vide his separate statement already made on 07.10.2022, Sh.Arun Dogra, Counsel for OP has stated that the matter has been settled between the parties with the term that OP shall refund an amount of Rs.13,000/- to the complainant within a period of one month from 07.10.2022 failing which the OP shall be liable to pay the aforesaid amount alongwith interest @ 9% p.a. from the date of filing of present consumer complaint and nothing is to be paid by the complainant against the account/credit card in question. Vide her separate statement already made on 07.10.2022, Ms.Nikita Garg, Counsel for Complainant has admitted the statement of counsel for OP and prayed that the complaint be disposed of in terms of aforesaid settlement in the Lok Adalat.

          In view of the statement of the counsel for the parties and in terms of the settlement, the complaint stands disposed of by passing the following order:-

          (i)      OP shall refund an amount of Rs.13,000/- to the complainant      within a period of one month from 07.10.2022.

          (ii)      In case the aforesaid amount/defaulted amount is not paid by the         OP within the stipulated period, then OP shall be liable to pay the same alongwith interest @ 9% p.a. from the date of filing of present consumer complaint i.e. 07.05.2019 till its realization.

          The award is accordingly passed.

          Certified copies of this order be sent to the parties free of cost. The file be consigned.
