Today is fixed for E/R of W/A.

 

The DHR files hazira.

 

E/R of W/A issued against the JDR is received. The present Branch Manager, named Sri Sourish Sen is present on call.

 

From the papers submitted from English Bazar P.S., Malda, it appears that the W/A issued against the JDR was executed by arresting him and subsequently he was released on P. R. Bond with a direction to the JDR to appear before this Forum.

 

The JDR, Sourish Sen is taken into custody for the purpose of realization of the awarded amount and NOC.

 

The JDR files a petition along with NOC and one Draft being No.497641, dated 26.03.2015 of Rs.13,000/- in favour of the DHR and praying to accept the same.

 

The DHR personally appears and files two separate petitions praying to permit him to hand over the above mentioned NOC & Draft and in another petition he has prayed to dispose of this Execution Case on full satisfaction and also files photocopy of his Driving Licence for identification along with original.

 

The original Driving Licence of the DHR is verified with the photocopy and returned to him and petitions are taken up for hearing.

 

Heard both sides. Being asked by the Forum, the DHR submits that he is satisfied to accept the NOC and Draft with the amount as mentioned in the Draft as stated above.

 

Considered the prayer to hand over the NOC and Draft being No.497641, dated 26.03.2015 for Rs.13,000/- submitted by the JDR is allowed.

 

Accordingly hand over the NOC and Draft as mentioned above to the DHR on proper receipt.

In view of the above discussion there is no bar to allow the petition filed by the DHR for disposal of this Execution Case with full satisfaction; is hereby allowed.

 

Hence, it is

ORDERED,

 

that the Execution Application being No. 18/2014 be and the same is disposed of on full satisfaction.

 

Let copies of this order be supplied to the parties free of cost.
