ORDER

 This record is placed before the Bench in view of the put up petition. This Execution Application is fixed on 15.02.2018 for bringing order from the Hon’ble SCDRC, WB. Today a copy of the final order/judgment is filed dated 11.05.2017 passed by the Hon’ble SCDRC in the First Appeal no-A/1197/2014. From the said judgment it is evident that being aggrieved and dissatisfied with the judgment passed by this Ld. Forum dated 03.09.2014 in the C.C. No-316/2010 the aforementioned appeal was preferred by the Jdr. The Hon’ble SCDRC has pleased to allow the said appeal after setting aside the order/judgment passed by this Ld. Forum and it is also mentioned in the said judgment by the Hon’ble SCDRC that the complaint stand dismissed.

In view of the abovementioned order/judgment of the Hon’ble SCDRC the present Execution Application has lost its force and hence it is rejected.

Therefore it is ordered that the Execution Application being no-163/2014 is hereby rejected having no merit.

Though this execution application is fixed on 15.02.2018, but in view of the order passed by the Hon’ble SCDRC, there is no need to place this record on the said date.

Let plain copy of this order be supplied to the parties free of cost as per the provision of CPR, 2005.
