Complainant absent. No representation. Opposite party 2 represented. Complainant is continuously abstaining from the proceedings of the complaint from 07-08-2019. Thereafter the notice from this Commission is received by the complainant on 17-03-2020. Though the notice was received by him he filed a memo stating that he is not ready to participate the proceedings of his complaint before this Forum. Inspite of receipt of notice from this Commission, he is continued to abstain from the proceedings of the complaint. After that on 21-10-2021 another notice was issued to him directing the complainant to appear before this Commission. Though the complainant received the said notice on 02-11-2021, he did not appear before this Commission and not adduced any evidence in support of his case. On verification of records, it can see that the complainant filed a memo on 05-11-21 stating that he will not participate the proceedings of the complaint by raising some untenable contentions. From the conduct of the complainant it can be seen that he is not interested to proceed with complaint. Hence the complaint is dismissed for default under Section 13(2)(C) of the Consumer Protection Act, 1986.
