The case is fixed for argument.
After hearing argument/written argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The complainant’s case is that he being a small farmer applied for electric connection to his submersible pump for irrigation purpose on payment of requisite fees and charges including Quotation amount of Rs.27,130/- with further direction upon the complainant to submit material purchase receipt as one of the conditions for effecting service connection but the complainant raised objection to the payment of Rs.27,130/- as the service connection charge applicable to his case is only Rs.4,000/- as per Clause-6 of WBSEDCL Procedures – A (2010).

The O.P. contested the case by filing a written version contending inter alia that the complainant is not entitled to get the electric connection as prayed for as he has to supply materials for Rs.59,282/- according to the Rules of Turnkey basis as contained in the Quotation dated:14-12-2010 and as such the complainant cannot get the benefit of Clause-6 of WBSEDCL Procedures – A (2010).
-:Decision with reasons:-
Having regard to the facts of the case, materials on record and the submission and contention on both sides the Commission finds that though the O.P. is ready and willing to effect electric connection to the complainant as prayed for but according to the Turnkey contract the complainant has to supply the electrical materials for Rs.59,282/- as contained in the Quotation dated: 14-12-2010 and the complainant has not yet fulfilled his part of contract and as such he is also not entitled to get the benefit of the aforesaid Clause-6 of WBSEDCL Procedures – A (2010).
Accordingly it is ordered……..
That the case is disposed of on merit by directing the O.P. to install electric connection to the complainant as prayed for subject to supply of electrical materials for Rs.59,282/- as per terms and conditions of Quotation within two months from this date I/D the order of the Commission may be executed in due process of law.
Both parties be supplied copy of this Order free of cost.
