None present for the complainant and opposite party no.2. By order dated 19.8.2009, the complainant was directed to file evidence by way of affidavit with the Registry with copy to both the opposite parties within 8 weeks. Thereafter, further directions were also given for filing evidence by way of affidavit by the opposite parties and filing of brief synopsis of written arguments etc. and the matter was ordered to be listed on 5.1.2010 for final hearing. The said order clearly stipulated that the next date and time schedule has been fixed according to the convenience of counsel appearing on both sides and anyone seeking adjournment or not adhering to the time schedule shall have to either face consequences thereof or pay exemplary costs. In spite of these directions, the complainant did not file evidence by way of affidavit nor appeared in this Commission on 5.1.2010, yet we granted another opportunity to the complainant to file evidence by way of affidavit before the next date of hearing with copy to the counsel for opposite parties and the matter was ordered to be listed on direction board on 18.2.2010. On 18.2.2010 when the matter was taken before the Registrar, no one appeared for the complainant nor any evidence by way of affidavit was filed. The Registrar also directed the complainant to file affidavit evidence within four weeks with advance copy to the opposite parties and the matter was ordered to be listed on 20.4.2010. On 20.4.2010, no one appeared for the complainant nor the affidavit evidence was filed and the matter has been listed before the Bench today. Today also, no one appeared for the complainant nor affidavit evidence has been filed in spite of repeatedly granting opportunity to the complainant to file affidavit evidence. In view of this, we are left with no alternative but to dismiss the original petition for want of filing evidence in support of the complaint. The complaint is dismissed with cost of Rs.25,000/- to be paid by the complainant in the ‘Consumer Legal Aid Account’, N.C.D.R.C.
