The case is fixed for argument. After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: - The Complainant’s case is that he entrusted the O.P./Builder to do certain house building construction work at Rs.5 Lakh. Though the entire payment has been made but the O.P. left the job unfinished compelling the Complainant to get the incomplete work done at his own cost. The Complainant has approached this Commission for recovery of the expenses already incurred by him. The O.P. contested the case by filing a written version contending inter alia that the construction work already done by them has exceeded Rs.5 Lakh and as such the Complainant is not entitled to get any relief in this case. Contd……p/2 Page: 2 . -: Decision with reasons: - Having regard to the facts of the case, submission, contention and documents on both sides the Commission finds that there has been a Contract Form signed by both parties in which it is stipulated that the cost of construction of roof of the first floor is Rs.3,018/- per Sq. Ft. and considering the measurement of the constructed roof the O.P. is to get more than Rs.5 Lakh which was the initial payment made by the Complainant to the O.P. Ld. Advocate on both sides have however agreed on this point. The Contract Form as referred to above is not as such enforceable as it is incomplete in material particulars and this Commission has no power and jurisdiction to execute and enforce an incomplete agreement. Both parties have entered into the transaction at their own risk and expenses. The Commission therefore finds no deficiency in service on the part of the O.P. Hence it is ordered…….. That the case be and the same is dismissed on contest but without cost.
