Present Revision Petition has been filed against the order dated 3.9.2016 passed by the M.P. State Consumer Disputes Redressal Commission, Bhopal (for short “the State Commission”) in F.A. No.543/2015, by which the Appeal preferred by the Petitioner herein had been dismissed. The Petitioners approached this Commission by filing the Revision Petition with a delay of 673 days. In the Application seeking condonation of delay, which consists of 5 paragraphs, the explanation has been given only in paragraphs 2, 3 and 4, which is reproduced below: “2. That, it is submitted that immediately after the impugned order was passed by learned State Commission of Madhya Pradesh at Bhopal the applicant contacted his counsel at Delhi and handed over all the relevant documents to him. The counsel had assured him that the revision will be filed within time and for that the applicant had also deposited full fees as asked by the counsel. 3. That, applicant on being assured by his then counsel return to his city at Indore after being confident that his case will be filed within limitation. Thereafter, he contacted his counsel various times who again and again assured him that he will file the case and he need not have to worry. The applicant being a lay man trusted him but to his utter surprise and shock almost after more than a year his then counsel sent all the documents by courier by informing that he won’t be able to file the case. 4. That, applicant after that immediately contacted his present counsel who after going through the entire matter has filed the present revision before this court without any inordinate delay on his part.” From perusal of the aforesaid paragraphs, we find that neither any date has been mentioned not the name of the Counsel has been given as to whom the documents were sent. The explanation is vague and cannot be accepted as reasonable for condoning such an inordinate delay. The Application seeking condonation of delay is dismissed. Consequently, the Revision Petition also stands dismissed. |
