Final Order / Judgement

               The Case of the Complainants is that complainants purchased air tickets from Kolkata to Guwahati on 17/05/2017 and return tickets on 22/05/2017 at an amount of Rs.36,075/- from Indigo
Airlines i.e. Opposite Party. On the date of journey complainants reached the boarding counter at 6.16 A.M. 25 minutes before the departure of the scheduled plane but the officials on duty disallowed them to board the plain on the ground that the gate was closed. Thereafter complainants cancelled their all tickets and intimated the same to the Customer Relation Officer of Indigo Airlines on 17/05/2017 and also demanding Rs.1,00,000/- towards compensation and lodged a complaint before Airport Authority on 18/05/2017 as well as Appellate Authority of Indigo Airlines on 06/06/2017. It is stated by the complainants that the customer relations of Indigo Airlines send a letter on 13/06/2017 disallowing the demand of the complainants. It is further stated that complainants again placed their demand of air fare, compensation etc. before the concerned authority of Indigo Airlines on 20/09/2017. Therefore, complainants received a letter dated 31/10/2017 from Inter Globe Aviation Ltd. that they disallowed all the demands of the complainants which compelled the complainants to file this instant case praying direction upon the o.p. to pay Rs.36,075/- along with compensation of Rs.3,00,000/-.

                Registered notice has been served upon the o.p. in spite of that none appeared on behalf of them. Hence the case was proceeded ex parte against them.

                In order to prove their case complainants filed evidence wherefrom it appears that their boarding time was 6.05 A.M. on that very day. Further it appears from the petition of complaint that on that day complainants reached at the boarding counter at 6.16 A.M. only before 25 minutes of the departure of their flight. The Indigo Customer Relations stated by a letter dated 13/06/2017 that “please be at departure gate at the indicated boarding time. Any passenger failing to do so may be refused boarding privileges”. It further appears from the letter dated 31/10/2017 sent by the o.p. that they have already refunded Rs.6,003/- on 20/05/2017 to one of the complainants. Complainants also stated that they have received an amount after cancelling air tickets.

                From the above discussions we are of opinion that the complainants did not reach at the boarding gate on scheduled time and as such o.p. has no deficiency in providing service and moreover complainants fail to prove their case by filing cogent evidence.

                Hence, it is,

Ordered

                That the CC No. 351/2018 is hereby dismissed without any cost.
