JUSTICE SRI.K.R.UDAYABHANU    : PRESIDENT

          The appellant is the complainant in CC.4/01 in the file of CDRF, Thiruvananthapuram.  The complaint stands dismissed for default.

          2. It is submitted by the complainant that the evidence was over and  argument notes were also filed.

          3. In the circumstances and in view in the stakes involved we find that a considered order is required.  In the result the order of the Forum is set aside.  The matter is remitted back to the  Forum.  The Forum is directed to hear both parties and dispose  of the matter by a considered order.

          4. The appeal will stand posted before the  Forum on 5.9.09.

          Office is directed to forward a copy of this order to the Forum urgently.
