RAM SINGH CHAUDHARY, JUDICIAL MEMBER:

           

 

1.                Present appeal has been filed by the appellant-complainant against the order dated 05.10.2018 passed by learned District Consumer Disputes Redressal Forum, Karnal (in short “District Forum”) vide which complaint of the appellant-complainant was dismissed for want of prosecution.

3.                Feeling aggrieved therefrom, present appeal has been filed by the appellant-complainant for setting aside the order dated 05.10.2018.

4.                Arguments have been advanced by Sh.M.K. Rohilla, Advocate for appellant, Sh. Ashish Kapoor, Advocate for respondent No.1, Sh . M.S. Khillan, Advocate for respondent No.2 and Sh Vivek Dowal, Advocate for respondent No.3. With their kind assistance the entire appeal has been properly perused and examined.

5.                Keeping in view the contents of the appeal and to adjudicate the complaint on merits and in the interest of justice, the order dated 05.10.2018, vide which complaint of the present appellant-complainant was dismissed for want of prosecution is set-aside for all intents and purposes. It is further clarified that no amount of costs has been imposed on account of the fact that the total matter involved in the present appeal is of Rs.10,000/-. Hence, while exercising the judicial powers in order to deliver the justice to the parties, impugned order dated 05.10.2018 is set-aside without any cost. Parties are directed to appear before learned District Forum, Karnal on 15.05.2019. The appeal file be consigned to the record room.
