O R D E R

This complainant’s appeal calls in question the correctness of the order dated March 10th, 2017 passed by District Consumer Disputes Redressal Forum, Sonepat (for short ‘District Forum’), whereby complaint was allowed. For facilitation, operative part of the order is reproduced as under:-
“……Accordingly, we hereby direct the respondents No.1 and 2 to pay Rs.75000/- each in lumpsum to the complainant within a period of 60 days from the date of passing of this order failing which the above said amount shall fetch interest at the rate of 9% per annum from the date of passing of this order till its realization.”

By filing the complaint, Krishan Singh-complainant alleged that on December 17th, 2015 while he was preparing tea in a Chaubara (only one room on the first floor) of his house at about 10.30 a.m LPG cylinder caught fire and cash of Rs.1,15,000/-, double bed, fridge, cooler, television, jewellery etc were burnt to ashes. Fire Tender was called and extinguished the fire. Police Station Barauda, Food and Supply Office, Sonepat, Deputy Commissioner, Sonepat and Shaheed Rajvir Singh Gas Service, Rohtak were informed. The complainant filed complaint against Indian Oil Company and Shaheed Rajvir Singh Gas Service, Rohtak.
3. Indian Oil Company-opposite party No.1 was proceeded ex parte.
4. Learned counsel for the appellant has urged that the amount of compensation awarded is on lower side and deserves enhancement.
5. On December 17th, 2015 the LPG cylinder of the complainant caught fire resulting in damaging of household articles, cash and jewellery. The complainant did not lead any cogent evidence to prove that he suffered loss to the tune of Rs.12,00,000/-, which he claimed in his complaint. The District Forum directed the opposite parties to pay Rs.75,000/- each in lumpsum to the complainant. This Commission is of the view that the appellant-complainant has been adequately compensated and no case for interference in the impugned order is made out. The appeal is dismissed.
