16.6.2015 Present:- Sh.N.K Ranbir Singh, complainant in person.

 

Heard on the point of admission of complaint. The crux of the allegations of the complainant is that he is holder of insurance policy bearing No.1484170 with HDFC Standard Life Insurance Company Limited. The material allegation of the complaint is that a call was received by the complainant from the mobile No.099030-66918 that his two installments have been deposited and he has to pay the insurance premium for 5 years i.e. up to 7 years. The complainant has not deposited the premium. The complainant was also informed that he has to pay more premiums for 5 years. The complainant was also told that if he paid one more installment and is to issue demand draft of two installments of Rs.30,000/-, then 35% as bonus shall be given by company and a medical card for four family members shall be issued. On the basis of this medical card, the complainant may be entitled to get free medical treatment for four family members. The complainant paid Rs.30,000/- through demand draft, but later on he noticed that his two installments have been deposited on 7.1.2012, 18.1.2013 and 24.12.2013. It is alleged that installments made by the complainant on 24.12.2013 was received against receipt, but this amount has not been deposited for previous policy. Due to this, the policy had lapsed and complainant had to pay Rs.2530/- as interest. An amount of Rs.15,300/- was received by opposite party No.3. The complainant further alleged that he does not want to continue policy bearing No.16686390 as it has been issued without his wishes and consent. On this back drop of the facts, the complainant has filed the present complaint at Bathinda.

We have heard complainant on the point of admission of complaint.

Opposite party No.1 is insurance broker with office at Thana; opposite party No.2 is insurance company with branch office at Kolkatta; opposite party No.3 is one Sandip Roy stated to be agent of opposite party No.2; opposite party No.4 is one Subir Dutta stated to be agent of opposite party No.2 and opposite party No.5 is office of HDFC Standard Life Insurance Company Limited at Bathinda.

It is submitted by the complainant that one of the office of opposite parties is at Bathinda. The complainant is in Army and posted at Bathinda, therefore, this Forum has territorial jurisdiction to try and decide the present complaint. The documents placed on file show that all the transactions have been done at Kolkatta. The material allegations are against opposite party Nos.3 and 4. They are also residents of Kolkatta. The alleged transactions of these persons have been done at Kolkatta. There is nothing on record to show any transaction at Bathinda. Therefore, this Forum has no territorial jurisdiction to try and entertain the present complaint only for the reason that one of the branch of opposite parties is at Bathinda. Accordingly, the copy of documents be retained and complaint in original alongwith copy of this order are directed to be returned to the complainant against the valid receipt. File be consigned to the record room.
