EXPARTE  JUDGMENT

 

1.            This is a complaint U/S-12 of the Consumer Protection Act,1986.  The brief  fact  of the  complaint is  that one Sri Rabi Narayan Das booked  a new DTH connection  with  the opp. party  on 09/11/2018  and  the  price  for  new  connection was  Rs.1,999/-  and  complainant    have not  paid  the  installation  charged  as  it is  to be  paid   after installation. The payment was  made through google pay  and Anx-A is  the  transaction   statement.  The  complainant  received  a confirmation  from  the  opp. party  citing  the  work order  no-690637     and the  customer ID is 1004665020 which  will be connected  shortly  . Anx-B  is the  copy of  message  received  by the  complainant.

2.               The complainant   thereafter  on 14/11/2018  asked  the  customer  care  about  his service  request  no- 806808  and he was  informed  by the  representative   of the opp. party   that  installation   will be  completed   within 10-15  days  of payment . The    complainant again   after  15 days  of payment i.e.  23/11/18  made enquiry  and  came to know  that   an order  has been  assigned  to M/S L.M. Enterprise in Guwahati and it will  be installated.

3.                Thereafter  on  contracting  M/S L.M. Enterprise the  concerned  person  denied  installation stating  long distance  from his  office to the place  of  installation   and  advised him to go  to  nearest   TV  store  to get  installation  done , but  no address  of such  store  was  provided  . The  complainant thereafter , lodged  a complaint against the distributor  but the customer  care  denied  of having  any  complaint  numbering system.

4.                In such  a  situation the  complainant made  several  request  to  resolve the issue and get  installation done. Each of time  the  customer  care  representative made  a reply  stating   that  we  have forwarded  your  complaint  to our  higher authority  and  your  problem  will  be  resolved  within  24-48 hours.  Anx-C1 & C2 are   record  of such  communication .Ultimately  after  passes  of  reasonable time the  complainant   requested  the opp. party to cancel    his  connection order  and refund  the advance  deposit  , but the customer  care  representative  denied  refund  stating   that  they  donot have provision  of refund  and  cancellation.

5.               After  the  above incident the  complainant  gave  a  complaint  at   National  Consumer  Helpline which lodged  a complaint    numbering  1022701  on  26/11/2018   and as  per advice  of   the  national  consumer  helpline   send a mail at customer

6.               The complainant again  as per  advice  of National  Consumer  Helpline  write a  complaint   to  telecommunication  department but the  department  has  closed  the complaint    that  it  does not pertain  to their organization.

7.              In the situation   stated  above the  complainant  moved  this forum  by sending a  final  reminder  to the opp. party  . The  copy   of which  is  annexed  as  Anx- H.  In   the  meantime  on  15/12/2018, opp. party  called  the   complainant  stating  that opp. party is  ready  to refund  the   advance   money  within  7 days  without  interest . But  the opp. party prevented  the  complainant  from  lodging complaint   by  false promises . For the above  harassment  & false promises  the present  complaint is filed  for  the relief  directing  the  opp. party  to refund  Rs.1,999/-  along  with  18% interest  &  a sum  of Rs.50,000/- towards  physical  &  mental  agony &  Rs.1,000/-   as  cost of the  petition .

8.              We have  gone  through  all  the documents  as  annexed  with the   record  &  perused  . The complainant have taken step  &  notices  were  delivered  but opp. party  never  filed W/S  and matter  was  heard exparte.

9.            We have considered the evidence of the complainant made in this affidavit .He had made  his statement testifying all  the annexures as Ext-1,2,3(a), 3(b) further testify EXt-4,5,6,7 & 8 .The said relevant documents are sufficient to establish his claim for connection of new DTH from the opp. party  on payment of Rs.1,999/- . The opp. party had not responded properly and have failed to provide the said connection . The opp. party did not respond even after getting several reminders as well as  after paying advance amount from the complainant. As such the  complaint petition is found with merit and is proved by the  complainant . The suit is decreed in favour of the complainant and the opp. party is directed to make  the  following payment to the  complainant.

i) To refund the advance payment of Rs.1,999/- along with 6% interest from the date of filing the complaint .

ii) The opp. party have to pay compensation to the tune of Rs.25,000/- to the  complainant for  harassment  and mental  agony  caused  to the  complainant &

iii) To pay the cost of the suit Rs.1,000/- to the  complainant  within 45 days from the date of judgment .

10.                  The opp. party is directed to pay  the said amount within 45 days from the  date of judgment and  in default of payment of  the decretal amount the opp. party shall  have to pay an interest @12% per annum till  realization.
