It is only the methodology of allotment.<br /> Consequently it would not make any difference <br /> whether any person gets plot by way of auction <br /> or by way of allotment or by any other means of allotment."<br /> Purchase of booth site by the complainant in auction is not to generate profit from the booth itself in respect of which he has sought redressal of his grievance and as such this transaction cannot be branded as a commercial purpose.<br /> Under the peculiar circumstances, we order that if Improvement Trust is unable to restore status quo as per the original lay out plan dated 4/2/1987, it should refund the purchase price of booth No.125 with interest @ 9% p.a. from the date of its deposit till realisation alongwith cost of litigation to the tune of Rs.1000/- payable by the opposite party to the complainant within one month from the receipt of copy of this order.<br /> Let certified copies of judgment rendered be supplied/dspatched to the parties without any unnecessary delay and thereafter file be consigned to record room.<br /> <br /> Announced : ( Surinder Mittal ) ( A.K.
