The counsel for  complainant argued that the complainant has paid the premium amount to purchase insurance policy to insured  his vehicle under  third party insurance policy therefore the premium paid for the consideration the complainant is consumer  and forum has jurisdiction. For the accident  arose out of motor vehicle the compensation is to be awarded by District Court under motor vehicle tribunal Act. When a special tribunal is created to award compensation in case of motor accidence claim cases then the consumer forum has no jurisdiction to entertain the complaint to award compensation therefore the case is not  admissible hence  dismissed.
