File taken up today on the application moved by learned counsel for the OPs.
An application has been moved by learned counsel for the complainant for deleting the name of complainant no.3 Khajani from the array of parties having been dead. He also produced the dead certificate of the deceased Khajani. Learned counsel for the OPs has endorsed his no objection on the said application. Heard. In view of no objection of learned counsel for OPs as well as in the interest of justice, said application is allowed. Amended title filed.
Learned counsel for the OPs has made a statement that he has received the documents from the complainant. The insurance company has compromised the said complaint with the complainant for full and final settlement of Rs.1,00,000/-. The insurance company shall deposit the said amount within 45 days from the date of this order.
The Learned counsel for the complainant has made a statement that he has read and heard the above-mentioned statement given by learned counsel for the OPs. According to that, the matter has been full & final settled in Rs.1,00,000/-, the said amount be distributed in equal share to Karamjeet and Sushila
Keeping in view the statement made by learned counsel for both the parties, the present complaint stands disposed off with the direction the IFFCO TOKIO General Insurance Company shall make the payment of Rs. 1,00,000/- within 45 days from the date of passing of the order, if the insurance company fails to make the payment of aforesaid amount within 45 days, the insurance company shall be liable to pay interest @9% per annum from the date of passing of the order till payment. The said amount be distributed in equal share to Karamjeet and Sushila.
Complaint stands disposed off accordingly. File be consigned to the record room after due compliance. It is directed that both the parties shall remain bound by their own statements. Copy of order be supplied to the parties free of cost.
