Learned counsel for petitioner states that he has no instructions in this case from the petitioner. The application for restoration was dismissed in default on 20.9.2012 due to non-appearance of petitioner as well as due to non- deposit of adjournment cost. Since petitioner sought time to deposit the cost, adjournment was granted to petitioner subject to payment of Rs.2,000/- as further cost. Petitioner has not deposited the previous adjournment costs, nor he has given any instructions to his counsel. Under these circumstances, the petition stands dismissed for non-prosecution as well as for non-compliance of the orders passed by this Commission.
