SRI.P.V.JAYARAJAN: PRESIDENT
This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The said notices were accepted by the opposite parties 1 & 2 on 11/01/2024 and 13/01/2024 respectively. After accepting the notice, 1st opposite party entered appearance and filed written version dyeing the allegation raised by the complainant. After accepting the notice the 2nd opposite party failed to appear before this Commission and hence on 27/02/2024, the 2nd opposite party was called absent and set ex parte. When the case came up for consideration on 05/10/2024, both parties submitted that there is a chance of settlement and hence the matter was referred for mediation. When the case came up for consideration today, both parties were present and submitted that the matter is settled. The compromise memo signed by both parties is also filed before this Commission. As per the compromise the opposite parties have agreed to pay Rs.5,000/- as compensation to the complainant and further agreed to replace the compressor with an extended warranty of 4 years from the date of installing it and further agreed that the opposite party will not charge any additional cost including service charges for the said installation. Both parties agreed that 30 days time can be granted to the opposite party for compliance of the order. The compromise memo dated 02/11/2024 is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is fit case to be allowed in terms of compromise.
In the result the complaint is allowed in terms of compromise. The compromise memo dated 02/11/2024 shall form part of this order. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
