1. This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. Opposite parties 1 & 3 entered appearance and filed written version denying the allegations raised by the complainant. The notice issued to the second opposite party was returned with endorsement “refused ’’. Hence the second opposite party was called absent and set exparte on 10/01/2020. Inspite of giving sufficient opportunities, the complainant failed to file affidavit to substantiate his case against the opposite parties. As the complainant was continuously absent, this commission issued a notice to the complainant to appear before this commission today to further proceed with this complaint. When the case came up for consideration today, the complainant was absent and there was no representation. The notice issued to the complainant from this commission was seen accepted by the complainant on 31/01/2024. As the complainant has not filed affidavit or marked any documents to support the allegations raised by him against the opposite parties. We find that there is no piece of evidence to prove the allegations raised by the complainant against the opposite parties. In the above circumstances, we find that the complainant has miserably failed to establish his case against the opposite parties. In view of the above discussions, we find that this is a fit case to be dismissed for want of evidence.
In the result, the complaint is dismissed. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
