In brief, the grievance of the complainant is that he was deposited Rs. 500/- on 22.08.2016 vide receipt no. 9286453. It is alleged that despite deposit of said amount of bill the OP closed his mobile connection on 03.09.2016 and asked the complainant again deposit the said amount of bill and he has to deposit again Rs. 570/- on 05.09.2016 vide bill no. 928660 and his mobile connection was restored by the OP. The complainant further alleged that due to the act and conduct of the OP he has to suffer mental agony, physical harassment as well as financial loss. Hence, it amounts to deficiency in service on the part of OP and as such, he has to file the present complaint.
2. OP has failed to come present. Hence he was proceeded against exparte vide order dated 17.11.2016.
3. In order to make out his case, complainant has tendered into evidence affidavit Mark A and documents Annexure C-1 to Annexure C-4 alongwith supporting affidavit.
4. The complainant in person reiterated the contents of the complaint. He submitted that he has deposited Rs. 500/- on 22.08.2016 vide receipt no. 9286453. Despite deposit of said amount of bill the OP closed his mobile connection on 03.09.2016 and asked the complainant again deposit the said amount of bill and he has to deposit again Rs. 570/- on 05.09.2016 vide bill no. 9286460 and his mobile connection was restored by the OP. The OP did not bother to appear and contest the claim of the complainant. We have examined the material on record. Nothing has come on record to controvert the plea of the complainant. In these circumstances, the complaint of the complainant is partly allowed. The OP is directed to refund Rs. 500/- and also to pay Rs. 500/- as compensation to the complainant. Therefore, the OP is liable to pay Rs. 1,000/- to the complainant. Certified copies of the order be sent to the parties free of costs. File be consigned to the record room, after due compliance.
