Learned counsel for respondent has filed vakalatnama today. The same is taken on record. Learned counsel for respondent has no objection if the impugned order passed by the State Commission is set aside and appeal is restored. Vide order dated 22.12.2012 the appeal filed by the petitioner was dismissed in default due to non-prosecution. In view of the no objection given by learned counsel for respondent, the impugned order is set aside, subject to payment of Rs.10,000/- as cost. Cost be paid by way of demand draft in the name of respondent within six weeks. Accordingly, present petition stands allowed. Parties are directed to appear before the State Commission on 16.7.2013 for direction. Dasti to both parties.
