Consumer Disputes Redressal Forums consumer case(CC) CC/07/131 Of 2007 Jagjit Singh Complainant Versus ICICI Ins. Respondent For Complainant Sh.P.S.Hanspal For Respondent Vishal Ahuja This complaint has been filed by Jagjit Singh complainant against ICICI lombard and others opposite parties seeking direction against the opposite parties numbers 1 and 2 to make payment of the insured amount of Rupees 3,62,184.00 alongwith interest for the total loss of Tata Indica Car damaged in vehicular accident and for monetary compensation. The opposite parties appeared and filed written statement admitting that the vehicular of the complainant was insured with the opposite parties. However, it is submitted that the car was purchased for private purpose, insured for private purpose, but the complainant was using the same for commercial use. The opposite parties have rightly repudiated the claim of the complainant and there is no deficiency in service on the part of the opposite parties. The parties led evidence. We have heard the counsel for the parties and have gone through the file. In the ultimate analysis of our discussion, we accept the complaint and direct the opposite parties to pay to the complainant a sum of Rs.3,62,182.00 alongwith interest at the rate of 9 per cent per annum from the date of repudiation till realization alongwith costs of Rs.1000.00. Above directions be complied with by opposite parties No.1 and 2 within one month from the receipt of copy of the judgment. File be consigned. Dated 12.2.2008 Surinder Mittal A.K.
