ORDER

PER SANJEEV BATRA, PRESIDENT

1.                           The complainant has invoked the jurisdiction of this Commission and alleged deficiency in service on the part of the OPs by raising a consumer dispute with regard to less payment of the maturity amount by the OPs towards the insurance policy purchased by complainant. It has been submitted that believing the representation and assurance of OPs, the complainant purchased the insurance plan with maximum benefits upto Rs.3,35,000/- against the policy No.01438789 with policy term of 19 years and the commencement of the policy period started w.e.f.26.02.2005, due date of last premium 26.02.2022 and maturity date as 26.02.2023. The complainant has been paying the premium of Rs.10,879/- regularly. However, after expiry of the said policy, the insurance company only paid Rs.2,98,000/- instead of Rs.3,35,000/- as told by the help desk officer/agent of the OPs. The said act and conduct of the OPs is claimed to be deficiency in service on their part. So, by filing the present complaint, complainant has prayed that OPs be directed to pay the full maturity amount of Rs.3,50,000/- along with interest as well as compensation of Rs.2 lac on account of mental tension and agony suffered by the complainant.

2.                Pursuant to the notice of the complaint, Sh.V.S.Mand, Advocate appeared on behalf of OP1 and OP2 and when the case was fixed for filing written statement for today, he got recorded his statement to the effect that the OPs had already paid Rs.2,98,338/- to the complainant and now they are ready to pay the balance amount of Rs.55,581/- in lumpsum towards the full and final settlement of the claim of the complainant within 30 days from the date of receipt of copy of this order.

3.                The said offer has been duly accepted by the complainant who is present in the court along with her counsel Sh.Jatinder Arora and they prayed for disposal of the complaint accordingly.

4.                           In view of above settlement and recorded statements of the parties today itself, the present complaint stands disposed of with the direction to the OPs to pay Rs.55,581/- towards the full and final settlement of claim of the complainant within 30 days from the date of receipt of copy of this order. Further, the parties remain bound by their recorded statements. Copies of order be supplied to parties free of costs as per rules. File be indexed and consigned to record room.
