Today is fixed for admission hearing. Complainant side is found present and ready. Heard Ld. Advocate of the complainant side. Considered submission.

In course of hearing Ld. Advocate for the complainant side has emphasized of the documents annexed alongwith the complaint petition.

After going through the materials of the case record is is found that the complainant has not filed any premium receipt to show that the policy under the O.p. has been initiated. Moreso, policy document has not been filed. AS per case of the complainant side they have not received any policy document during the period 2014 to 2022. It is revealed that the complainant approached before the Insurance Ombudsman for getting relief but the prayer of complainant has been dismissed by the Insurance Ombudsman. It is also revealed that no documents have been filed to show that the claim of the complainant has been repudiated.

Considering all the above noted factors, this District Commission is of the view that the complainant has failed to establish prima facie case and so this case is not admitted.

As a result of which this case is dismissed. No order is passed as to cost.
