During the course of arguments, we enquired from the learned counsel representing the Respondent – ICICI Prudential Life Insurance Co. Ltd. as to what amount is payable by them to the Appellant today and what amount will be payable on maturity of the Policies. Learned counsel for the Respondent informs that going by the terms & conditions of all the three Policies and the amount of investment in the Policy Nos. 00929641, 06619934 and 07565935, a sum equivalent to 96% of Rs.15,00,000 (Rs.14,40,000) is payable to the Appellant as per today’s NAV. Counsel for the Appellant under instructions states that the Appellant is ready and willing to accept this amount or the amount which will be payable to him on 14th of November, 2007, the date of maturity of the three Policies. In view of these statements, we do not wish to dwell on the controversies raised in this Appeal, which will be deemed to have been settled on the Respondent by paying the due amount to the Appellant on maturity of the Policies as on 14-11-2010. With this observation, the appeal is disposed of. The amount shall be remitted to the Appellant within a week from 14-11-2010. Order Dasti to both the sides.
