The O.P. has filed one banker’s cheque for Rs.35,000/- being No.872654, dated 17.12.2014 drawn on ICICI Bank for handing over the same to the complainant.
Let the same be kept with the record.
The complainant files a petition duly verified along with photocopy of her Voter ID card praying to handover the cheque submitted this day. The complainant herself is present. She is identified by her Ld. Advocate and the photocopy of the Voter’s ID is verified with the original.
No objection is raised by the Ld. Advocate for the O.P.
So, there is no bar to hand over the cheque as mentioned above to the complainant. Let the banker’s cheque for Rs.35,000/- being No.872654, dated 17.12.2014 as mentioned above be handed over to the complainant on proper receipt.
The complainant files another petition to withdraw the case stating that her claim has been satisfied out of court.
The petition is verified. The same is not challenged by the O.P.
So, we find that the petition should be allowed.
Hence, it is
ORDERED
That the petition for permission to withdraw this case is allowed without cost.
Accordingly the complainant is permitted to withdraw the case.
This case is thus disposed of on withdrawal.
Let copies of this order be supplied to the parties free of cost.
