:- JUDGMENT :-

This complaint is filed by complainant against the Insurance Company for deficiency in service u/s 12 of the Consumer Protection Act, 1986. Brief facts are as follows-
[1] Complainant is resident of Wanowari, Pune. He had purchased ICICI Prudential Life Time Super Insurance Policy from the Opponents for Rs.3,00,000/-. He had surrendered the said policy on 21/02/2012. Office has acknowledged surrendered receipt and marked maturity value of Rs.3,36,749/-. But on 05/03/2012 instead of Rs.3,36,749/- opponent paid Rs.3,28,469.81 only. Opponent has failed to pay balance amount of Rs.8380/-. Hence complainant has filed this complaint for refund of balance amount of Rs.8380/- and for compensation.
[2] Opponent though duly served remained absent. Complainant has filed affidavit in support of his complaint and also filed correspondence through e-mail between the complainant and the opponent. Allegations made by the complainant on oath remained unchallenged. Hence, I pass the following order-
:- ORDER :-
1. Complaint is partly allowed.
2. Opponent Nos. 1 and 2 are jointly and severally directed to pay
Rs.8380/- to the complainant, within six weeks from the date of receipt of copy of order.
3. Opponent Nos. 1 and 2 are jointly and severally directed to pay
Rs.2,000/- by way of compensation for deficiency in service, compensation for physical and mental sufferings and cost of the litigation to the complainant within six weeks from the date of receipt of copy of order.
4. Complainant is directed to collect the sets which are provided
for the Hon’ble Members within one month from the date of order. Else those will be destroyed.
Copy of order be supplied to both the parties free of cost.
