Final Order / Judgement

​Order No.  2  dt.  30/05/2018

          The complainant filed this case stating inter alia that at the time of purchasing the policies he was informed that the premium paid by him was one time premium but after receiving those policies he found that the policies were for the sum assured of Rs.1,00,000/- (Rupees One Lakh) only for  each  policy but he will have to pay Rs.56,000/- (Rupees Fifty Six Thousand) only in respect of each policy. Since the complainant was misled by the agent of the insurance company, thereby the complainant filed this case.

            On perusal of the record we found that the policies relate to the years of 2007, 2010 and 2010 respectively since the case has been filed in the year 2018 and after the lapse of more than ten years. Thereby we hold that case is hopelessly barred by limitation since the complainant failed to file case within two years as envisaged in Section 24(a) of C.P. Act. Having regard to the said fact the case filed by the complainant is not maintainable and the same is dismissed in limini.
