During the course of arguments, it  has been pointed out by  ld.counsel for the Opposite Party that the complainant being nominee of insured Rakesh Kumar, has not lodged any claim relating  to the death of Rakesh Kumar, with the Opposite Party. He has also submitted that neither the complainant nor insured Rakesh Kumar has paid the next installments of both the policies, to the Opposite Party. So, the Opposite Party was not in a position to decide the claim case of the complainant regarding the death of insured Rakesh Kumar. Ld.counsel for the complainant submitted that the complainant has not received any intimation from the Opposite Party regarding non payment of the next premium of the policy obtained by Rakesh Kumar husband of complainant. Said installment  due in the first policy was for 18.1.2014 and in second policy was 18.10.2014. The insured could get the policy renewed/ revived within 2 years, so the policy had not yet been declared elapsed due to the non payment of the premium. The complainant is ready to submit the claim with the Opposite Party regarding the death of insured Rakesh Kumar under the two policies obtained by Rakesh Kumar from the complainant i.e. policy No.17376756 and policy No. 18580255.

Resultantly, the present complaint is disposed of with the directions to the complainant to submit the claim form duly filled in  alongwith relevant documents regarding the death  of insured Rakesh Kumar, to the Opposite Party under the aforesaid policies, within one month from the date of receipt of copy of this order and the Opposite Party is directed to decide the claim case of the complainant, within one month from the date of receipt of claim form duly filled in alognwith relevant documents, from the complainant relating to the death of Rakesh Kumar insured  under the aforesaid two policies. Keeping in view the peculiar circumstances of the case, the parties are left to bear their own costs.    Copies of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room. Case could not be disposed of within the stipulated period due to heavy pendency of the cases in this Forum.
